It is a simple matter of contacting the various credit agencies in South Africa to find out if you have been blacklisted due to the non-payment of debt. Normally this means that you have a judgement against you and that you have been summonsed to appear in the Magistrates court. In the event that you have been blacklisted, it may be difficult or even impossible to enter into any new credit agreements with a credit provider who runs a credit check on you. It is therefore imperative to have your name cleared as quickly as possible. There is only one way to get your name cleared in South Africa, and that is to get an order rescinding the judgement against you. To do this you will need an affidavit from the credit provider who has had you blacklisted stating that you have cleared your debt and the Magistrate can then rescind the order against you.
In most cases it is not a good idea to simply contact the credit provider and begin paying off your debt as this is an admission of guilt. First contact a lawyer or debt counsellor to interact on your behalf with the relevant credit provider. They will be able to negotiate lower interest rates as well as lower settlement amounts and therefore decreased monthly instalments for you. If however, the debt has been overdue for more than five years, the credit agency is obligated by law to remove the black listing against your name. It is more than likely that your credit provider will at this stage write off your debt and you will no longer be blacklisted.
